Ever Been Pressured into Buying Apple Gift Cards?

Have you ever been pressured into buying App Store or iTunes Gift Cards and then tricked into giving the gift card numbers to someone--who then used the card values? If so, there's important news for you.

Apple has agreed to a $35 million settlement to compensate victims who fell for this scam using their gift cards. In this article, I'll guide you through everything you need to know about the Apple gift card settlement—including who's eligible, how it works, and steps you MUST take to get your money back.

Understanding the Apple Gift Card Settlement

In the class action lawsuit known as Barrett v. Apple, a $35 million settlement has been reached with Apple Inc., addressing claims related to a common gift card scam. From January 2015 to July 2020, scammers deceived numerous consumers into purchasing App Store & iTunes Gift Cards. Then, they coerced these victims into sharing the gift card numbers so that the scammers could steal the value of the gift cards.

This type of scam is known as a "Victim-Assisted Gift Card Scam" because the victims themselves buy the gift cards. Even if they are manipulated or warned against it, they still complete the purchase and give the codes to the scammers. The scammers then often ask for more gift cards, applying more pressure and repeating their deceptive tactics until the victim can no longer continue, sometimes with severe consequences.

Many victims feel too embarrassed or ashamed to report these scams. Unfortunately, those who do report them rarely receive help from the companies involved, as these businesses see the victims as having helped the scammers.

Victim-assisted gift card scams are common and involve various types of gift cards, not just those from Apple. The lawsuit, however, contends that Apple did not support victims seeking refunds and unlawfully attempted to limit its liability for such incidents.

While denying all wrongdoing, Apple agreed to the settlement to compensate affected consumers.

Who Can Claim Part of the Apple Gift Card Settlement?

To be eligible for compensation under the Apple Gift Card Settlement, you must meet specific criteria:

  1. Purchase Period: You purchased an App Store & iTunes Gift Card between January 2015 and July 2020.
  2. Victim of Scam: You must have provided the gift card code to someone you did not know and who got the codes under pretenses.
  3. Lack of Refund: You did not receive a refund or compensation from Apple or any other source that covers the losses you incurred from the scam.

If you meet these criteria, you are considered a class member and can file a claim for reimbursement. This reimbursement aims to cover the financial losses you suffered up to the face value of the gift card purchased, less any amount previously refunded.

Questions About Filing a Claim

As I reviewed the Apple Gift Card Settlement documentation, I compiled a list of questions I believe consumers might have. Below, I provide answers based on my extensive experience dealing with gift card issues and consumer advocacy. Please note that my answers may guide and support you through your claim process; they are not official legal advice from the settlement administrators.

Q. Is it okay if I don't have all the documents?

My Answer: Start with what you have. Even if you don't have complete documentation, every bit helps. Check your bank statements, credit card records, and any digital communications for evidence of transactions or interactions with the scammer. Submitting some information is better than none and could still support your claim.

Q. What if I'm embarrassed or ashamed?

My Answer: It's important to remember that scammers are exceptionally skilled at manipulation. They craft convincing stories that exploit vulnerabilities, often using publicly available information to enhance their deception. By removing the stigma associated with being scammed, we encourage more people to come forward with their experiences. Sharing your story can help prevent others from falling victim to similar scams.

Q. Will others find out if I file a claim?

My Answer: I believe your privacy will be protected, but. put in a call and sent an email to the lawsuit handler to confirm that the information you provide is confidential and used solely for claim processing. I will update this post when I get a confirmed answer.

Q. What if I need help gathering documentation?

My Answer: If you find it challenging to collect the necessary documentation for your claim, remember you're not alone. Start by asking friends and family for help—they can assist in sorting through your records or recalling specific details. For more formal support, consider talking to bank staff, store clerks, or customer service representatives who might help retrieve transaction histories, phone records, or relevant communications.

Q. What if the emotional impact has been significant?

My Answer: If you're struggling with the emotional effects of being scammed, talking to a counselor or joining a support group for scam victims might be helpful. Addressing the emotional toll is as essential as handling the financial side.

Here are some resources I found:

Q. Should I still file a claim if I'm not sure it will be successful?

My Answer: Yes, absolutely. Filing a claim is your right, and any evidence you submit could contribute to receiving compensation. There's no penalty for a claim that's not approved, but you forfeit any chance of restitution if you don't file at all.

Q. Why should I bother filing a claim?

My Answer: Taking action moves you closer to potential compensation and supports broader efforts to hold companies accountable for their roles in scams. By filing a claim, you assert your rights and help reinforce consumer protections.

Wrapping It Up: Take Action

Filing a claim can feel daunting, especially after experiencing a scam. Still, it's a crucial step towards potential compensation and holding companies accountable for their role in such incidents. By claiming, you assert your consumer rights and contribute to a broader effort to enhance protections for all consumers. Even if you're unsure about the success of your claim, submitting it ensures you have a chance at restitution—doing nothing guarantees you receive nothing.

Additionally, this settlement highlights the necessity for corporate responsibility in preventing scams and supporting victims. It's a step towards ensuring companies actively safeguard their platforms from misuse. By participating, you help reinforce the importance of these standards.

Final Thoughts: You Are Not Alone

Remember, you are not alone in this. If the process becomes overwhelming, seek support—from friends, family, or professionals. Your experience could also help others come forward and protect themselves from similar scams. You're not just seeking reimbursement; you're standing up for your rights and helping ensure a safer consumer environment for everyone.

You can do this and I'm here to help if you have any questions.

Happy gifting!
