Have you ever been pressured into buying App Store or iTunes Gift Cards and then tricked into giving the gift card numbers to someone--who then used the card values? If so, there's important news for you.

Apple has agreed to a $35 million settlement to compensate victims who fell for this scam using their gift cards. In this article, I'll guide you through everything you need to know about the Apple gift card settlement—including who's eligible, how it works, and steps you MUST take to get your money back.

Understanding the Apple Gift Card Settlement

In the class action lawsuit known as Barrett v. Apple, a $35 million settlement has been reached with Apple Inc., addressing claims related to a common gift card scam. From January 2015 to July 2020, scammers deceived numerous consumers into purchasing App Store & iTunes Gift Cards. Then, they coerced these victims into sharing the gift card numbers so that the scammers could steal the value of the gift cards.

This type of scam is known as a "Victim-Assisted Gift Card Scam" because the victims themselves buy the gift cards. Even if they are manipulated or warned against it, they still complete the purchase and give the codes to the scammers. The scammers then often ask for more gift cards, applying more pressure and repeating their deceptive tactics until the victim can no longer continue, sometimes with severe consequences.

Many victims feel too embarrassed or ashamed to report these scams. Unfortunately, those who do report them rarely receive help from the companies involved, as these businesses see the victims as having helped the scammers.

Victim-assisted gift card scams are common and involve various types of gift cards, not just those from Apple. The lawsuit, however, contends that Apple did not support victims seeking refunds and unlawfully attempted to limit its liability for such incidents.

While denying all wrongdoing, Apple agreed to the settlement to compensate affected consumers.

Who Can Claim Part of the Apple Gift Card Settlement?

To be eligible for compensation under the Apple Gift Card Settlement, you must meet specific criteria:

  1. Purchase Period: You purchased an App Store & iTunes Gift Card between January 2015 and July 2020.
  2. Victim of Scam: You must have provided the gift card code to someone you did not know and who got the codes under pretenses.
  3. Lack of Refund: You did not receive a refund or compensation from Apple or any other source that covers the losses you incurred from the scam.

If you meet these criteria, you are considered a class member and can file a claim for reimbursement. This reimbursement aims to cover the financial losses you suffered up to the face value of the gift card purchased, less any amount previously refunded.

Submit your completed claim form and all supporting documents by the deadline October 15, 2024.

Opt-Out or Object

If you opt out of the settlement or wish to object to its terms, follow the instructions provided on the settlement website by the specified deadlines.

After you submit a claim, the lawsuit handler will review your submission for accuracy and completeness. They may contact you if further information is needed. If your claim is approved, you will receive details about the compensation amount and payment method. Approved claimants will receive compensation via the chosen method—ACH transfer or a mailed check.
